1. Service Description

Nyquest ("the Service") is an AI prompt optimization platform for large language model (LLM) API interactions. The Service optimizes prompts before dispatch to reduce token consumption, latency, and cost while preserving semantic intent and output fidelity.

Nyquest is provided by Nyquest AI ("we", "us", "our"). By downloading, installing, or using the Service, you agree to these Terms of Service.

The Service is distributed as a compiled package. The Nyquest engine includes all compression, optimization, and routing functionality. Configuration files are provided separately for deployment flexibility.

2. Free Access

Nyquest is free for everyone. No license keys, no registration, no paid tiers. The full compression engine — all 350+ rules, all features, all providers — is included in the distribution:

Nyquest is free for personal, academic, and commercial use subject to the terms below. We reserve the right to modify these terms at any time.

3. Intellectual Property & Protected Modules

Nyquest contains proprietary compression algorithms, optimization strategies, and pattern rules compiled into a native binary. These constitute trade secrets and confidential intellectual property of Nyquest AI.

You may:

Download, install, and use the Service for any lawful purpose
Modify configuration files (nyquest.yaml, .env) for your deployment needs
Integrate Nyquest into your applications, products, and services
Deploy the Service on your own infrastructure for internal or commercial use

You may not:

Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the compiled binary
Use decompilation tools, debuggers, or binary analysis techniques to extract algorithms, patterns, or logic from protected modules
Reconstruct, replicate, or create derivative works based on the protected compression algorithms or pattern rules
Remove, alter, or obscure any proprietary notices, labels, or identifiers in the distribution
Redistribute the compiled binary separately from the official Nyquest distribution
Offer the Service as a hosted or managed compression service to third parties (SaaS reselling)

4. Acceptable Use Policy

You agree to use Nyquest only for lawful purposes. In addition to the restrictions in Section 3, you shall not:

Use the Service to generate, distribute, or facilitate harmful, abusive, or illegal content
Submit false or misleading information to obtain the Service
Probe, scan, or test the vulnerability of the Service infrastructure or website
Use the Service to circumvent or violate the terms of service of any upstream LLM provider
Misrepresent the origin of the Service or claim authorship of Nyquest technology

5. Distribution & Updates

Nyquest is distributed exclusively through authorized channels. Request access at nyquest.ai/demo. The distribution includes a configuration template (nyquest.yaml.example) which you must copy and customize with your own provider API keys before use.

The current build targets Linux x86_64. Platform-specific components will not function on other platforms. Additional platform support (macOS, ARM) may be provided in future releases.

We may release updated versions at any time. There is no obligation to provide updates, patches, or new platform support. Updated distributions supersede previous versions.

6. Data & Privacy

Self-hosted deployments: Nyquest operates entirely on your infrastructure. No prompt data, API keys, or conversation content is transmitted to Nyquest servers. Compression happens locally. We have zero visibility into your data.

Cloud proxy: Prompts are processed in-memory for compression and forwarded to the target LLM provider. We do not store, log, or retain prompt content. Anonymous aggregate metrics (token counts, compression ratios, latency) may be collected for service improvement.

Downloads: We log download events (timestamp, IP address, filename) for abuse prevention and usage analytics. No personal information is required to download.

Privacy mode: The Service includes a privacy_mode configuration option that disables all prompt content in logs, restricting logged data to integer token metrics only.

7. API Keys & Security

You are responsible for the security of your own LLM provider API keys. Nyquest uses your API keys only to forward compressed requests to your chosen provider. Keys can be provided via request headers (pass-through, never stored), environment variables, configuration file, or the encrypted local vault.

The distribution includes a nyquest.yaml.example template with placeholder values. Never commit your actual API keys to version control or share your configured nyquest.yaml file.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nyquest does not guarantee that compression will not alter the semantic meaning of any specific prompt. Users are responsible for validating outputs in their own applications. We recommend enabling stability_mode in development environments to validate compression fidelity before deploying to production.

The platform-specific components are provided without warranty of compatibility with future operating system updates or hardware configurations.

9. Limitation of Liability

In no event shall Nyquest AI, its founders, contributors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service or inability to use the Service. Our total liability shall not exceed the amount paid by you (if any) for access to the Service during the twelve months preceding the claim.

10. Termination

We reserve the right to terminate or restrict your access to the Service at any time for violation of these Terms, including but not limited to attempted reverse engineering of protected modules or unauthorized redistribution.

Upon termination, the intellectual property restrictions in Section 3 survive indefinitely. You must destroy all copies of the protected modules in your possession.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Palm Beach County, Florida.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the website. Continued use of the Service after changes constitutes acceptance of the revised Terms. The version number and effective date at the top of this page indicate the current version.
